By accessing or using flakd.ca (the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

Account Terms

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• Guest checkout is available without creating an account.
• One account per person is permitted.
• We may suspend or terminate accounts that violate these terms.

Online Ordering

• Menu items, prices, and availability are subject to change without notice.
• Orders are confirmed when you receive an order confirmation from us.
• We reserve the right to cancel orders due to stock issues, pricing errors, or suspected fraud.
• Prices include applicable taxes unless otherwise stated at checkout.

Payment

• Payment is processed securely by Square.
• We accept major credit and debit cards.
• Payment is collected at the time of order.
• You agree to pay all charges incurred on your account, including applicable taxes and delivery fees.

Delivery

• Delivery is provided by Uber Direct.
• Delivery times are estimates and are not guaranteed. Actual delivery times may vary.
• You must provide an accurate delivery address and be available to receive your order.
• Delivery fees are displayed at checkout before you place your order.
• We are not responsible for delays caused by weather, traffic, or other factors beyond our control.

Refunds & Cancellations

• Orders may be cancelled within 2 minutes of placement.
• For quality issues, please contact us within 24 hours of receiving your order with photos of the issue.
• Approved refunds are processed to the original payment method within 5–10 business days.
• For delivery-related issues, contact us and we will work with Uber Direct to resolve the matter.

Intellectual Property

All content on this website, including logos, mascot illustrations, photography, and branding, is owned by Flak'd Burger and protected by applicable intellectual property laws.

• You may not reproduce, distribute, or create derivative works from our content without prior written permission.
• The Flak'd name, logo, and mascot are trademarks of Flak'd Burger.

User Conduct

When using our Service, you agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems or data
• Interfere with or disrupt the operation of the Service
• Submit false orders or fraudulent payment information

Limitation of Liability

• Our total liability is limited to the amount you paid for the specific order in question.
• Food allergen disclaimer: While we provide allergen information for our menu items, cross-contamination is possible in our kitchen. If you have severe allergies, please contact us directly before ordering.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
